Terms & Conditions

Please read these terms and conditions carefully. It contains important details about Your move and our services. Contact our office if You have any questions. JMI will provide the Moving Services described in the Quotation to You in accordance with the terms of this Agreement.

Packing and Moving

You must pack Your property into appropriate cartons and containers, unless packing services are specified in the Quotation in accordance with the Policies and Guidelines.

All containers and totes must have snugly fitting lids, all boxes must be packed, taped, and closed, without belongings sticking out at the top, bottom, or bulging on the sides. Boxes and totes must not weigh more than 23 kg. Boxes and totes deemed unsafe by JMI must be repacked by JMI and are subject to charges of $6.00 per box (supplied by JMI, subject to box availability) and the contracted hourly rate.

JMI will disassemble and reassemble furniture only when specifically requested by You at time of the Quotation or five business days prior to the Move Date.

If special tools are required, they must be supplied by You, the customer.

JMI will unload Your property into specific rooms at the Move To Location.

JMI may use one or more employees during the loading and unloading phases.

You must ensure all personal property allows for sufficient clearance for removal from the Move From location and delivery at the Move To location. If any property is deemed by JMI to be too large for safe removal or delivery, then You are responsible for the cost of storage of such property and all other costs associated with transporting to storage (labor, mileage, fuel, etc.).

The Move From location and Move To location must be in reasonable states of cleanliness and free from unsanitary conditions and safe for JMI employees, agents, or representatives to perform their duties. JMI may at its sole discretion, refuse service if it deems the move or environment to be unfit or unsafe.

You agree to pay JMI in accordance with these terms:

Hourly Rate

You will pay JMI an hourly rate as dictated on the Quotation for no less than a three-hour minimum charge during the loading, unloading, and travel phases of the move. Hourly rates will be applied in 15-minute increments.

Local Move Hourly Rates

The rate(s) listed in the Quotation includes all necessary materials and equipment to perform moving services. It does not include packing Your property, supply of packing materials, or unpacking services, unless specifically noted on the Quotation. Invoiced hours include travel time calculated from time of departure from JMI address to the return to the JMI’s location.

Packing Hourly Rates

If packing services are requested, the rate(s) listed in the Quotation includes the hourly rate for the required number of packers plus taxes. There are additional charges for packing materials such as boxes, tape, etc. If packing services are not listed on the Quotation, then You have elected to pack all of Your own property in accordance with the Policies and Guidelines.

We will refuse to pack any garbage, recycling, etc., and the site must be in good, clean, sanitary condition, otherwise service will be refused and no refund for time/hourly rate, or deposit will be given.

Deposit, Cancellation, and Rescheduling

A deposit of $400 per day for moving services are required or 10% of the Quotation, whichever is greater, is required to book Your move. Moves canceled with less than 15 business days’ notice are non-refundable. Moves rescheduled with less than 15 business days’ notice are subject to a $400 fee.

Payments

JMI will process full payment upon completion of the move. Acceptable payment methods are Visa, Mastercard, or Email Money Transfer to office@jasonsmoving.com.

Load Until Full Service

JMI crew will fill the truck(s) included in the Quotation to capacity and make one trip from the Move From location to the Move To location. If Your property requires an extra truck or extra trip, You will be given the opportunity to hire additional services from JMI on the day of the move, if resources are available. If You choose not to hire additional services, then the remaining items that do not fit in the designated truck(s) will not be transported by JMI and will be Your responsibility.

Safety

JMI may refuse any service or request that is deemed unsafe, unreasonable, unsanitary, or may cause property damage.

Crew Size

JMI may alter the number of workers included in the Quotation to complete any service. The hourly rate charged will be calculated according to the number of workers and trucks assigned. Reasons for an adjustment may include, but are not limited to, compliance with labor laws, hours of service regulations for drivers, available resources, scheduling requirements, excessive quantity of goods, and/or inclement weather.

No available JMI staff/resources

JMI staff, employees, may become unavailable on short notice due to but not limited to inclement weather, resignations strikes, work stoppages, sickness/illness, personal emergencies, etc.

Premium Rates

If the Move Date is required on a weekend or holiday, it will be subject to a premium rate. You will be informed of the premium rate policy and amount at the time of the Quotation.

Additional Charges

You will pay for additional moving supplies/costs as deemed necessary by JMI. Additional charges will apply if You request additional services that are not a part of this Agreement. The details of the circumstances in which these additional charges may apply are detailed throughout the Agreement. You are responsible for any additional costs incurred by JMI to render services to you such as but not limited to highway toll charges, towing charges due to customer negligence such as but not limited to failure to not plow, sand, or maintain your property, not providing adequate space for a moving truck in your driveway, and so on.

Time of Payment

You will pay JMI a deposit of $400 per day that moving services are required or 10% of the Total Quoted Price in the Quotation (whichever is greater) at the time of booking.

JMI will also make a pre-authorized charge on Your credit card for up to twice the Total Quoted Price in the Quotation. Final payments may be made by debit, MasterCard, or Visa only. No other payment methods are acceptable.

Limitation of Liability

JMI’s liability to You arising out of the performance of this Agreement, including but not limited to losses, damages, damage to property, property loss, costs, or expenses of any kind whatsoever, regardless of the cause, shall not in any case exceed the greater of the proceeds of insurance actually paid to JMI in respect of the specific damages claimed, or, if no such insurance proceeds are paid to JMI, then the total amount paid by You to JMI under this Agreement. Notwithstanding the forgoing, in no event shall JMI be liable to You for the following, which shall be entirely at Your own risk:

  1. Special, indirect, consequential, lost profits, or punitive damages arising out of or in connection with this Agreement.
  2. Any claim or demand made against JMI or You by any third party arising out of or in connection with this Agreement.
  3. Damages or delays in arrival or delivery of goods or services for unavoidable or unforeseen reasons, including but not limited to road conditions, or mechanical breakdowns, or a force majeure event, and any expenses arising from such;
  4. Any damage or defect which existed prior to the Move Date;
  5. Any and all damage caused by or due to any of the following: (i) any kind of interference or participation by You or any other person authorized by You;
  6. Your failure to provide adequate facilities, including but not limited to a lack of lighting, a lack of elevators, obstructive facilities or walkways including protruding walls or ceilings or sharp items, slippery surfaces, or oversized items in relation to undersized facilities provided by You.
  7. Any and all damage to any the following:

    1. items for which the You specifically waived JMI’s liability;
    2. items which were not in JMI’s immediate care, custody, or control; 
    3. contents of any boxes, bags, or other such containers, which are packed by You;
    4. items not properly prepared by You;
    5. items, furniture, or equipment moved full with contents therein;
    6. items or furniture with an inherent weakness, such as those already damaged or defective, or having underwent prior repairs;
    7. furniture, items, or materials which are weak due to their nature, usage, wear, or age;
    8. furniture or items of unique or fragile nature, such as glass, china, mirrors, or lamps;
    9. furniture or items of unique or fragile design, such glass on glass, glass on metal, glass legs, and etc.;
    10. furniture of unstable construction, ready-to-assemble the furniture, or furniture otherwise held together with tied joints fasteners or other defective or weak joints or connecting devices;
    11. oversized furniture and items which have to be maneuvered through tight passageways;
    12. mechanical or electronic function of any equipment; (xiii) soft tile or other unusual flooring;
    13. finishes that are wet or soft;
    14. pictures or artwork; and,
    15. live plants.

Time Limitation

You must notify JMI in writing of any claims of damages within 3 calendar days following completion of the move. If such notification is not given, You waive Your right to claim against JMI for such damages.

Insurance

You may purchase, at Your own cost, insurance to cover any damage, loss, expense, liability, or cost for which JMI is exempt from liability, and/or excess insurance coverage. Please refer to Section 1 of the Policies and Guidelines for further details about the insurance options available to You.

Remedies

If JMI is found liable to You for any damage, then JMI may, at its sole discretion, elect to (a) repair the damage, or (b) pay You for depreciated value of an item. If You receive such repair or payment, then You agree that this is Your sole remedy against JMI for such damage.

Indemnification

You shall indemnify and hold harmless JMI against any and all claim, damage, loss, liability, and costs, including reasonable legal fees, of defending any third-party claim arising out of or in connection with this Agreement. You shall indemnify and hold harmless JMI for any and all damage or loss due to Your failure to provide suitable facilities, including the provision of clear driveways, roads, and paths leading from and to the origin and destination addresses and such further or other facilities as may be required.

Miscellaneous

Dispute Resolution

In the event of breach or a dispute that cannot be resolved without third party intervention, the Parties agree to resolve their dispute through arbitration in accordance with the Arbitration Act, 1991, S.O. 1991, c. 17.

Choice of Law

The Ontario Provincial law will apply to and govern the interpretation of this Agreement.

Entire Agreement

This Agreement contains the entire agreement between the parties related to the move and replaces any and all other statements or representations (including pre-contractual representations), text messages, emails, and conversations, none of which form part of this Agreement or are binding on JMI unless they are expressly set out in the Agreement.

Modification

This Agreement may be modified by subsequent agreement of the parties only by a written document signed by both parties or an oral agreement only to the extent that the parties carry it out.

Severability

If any provision of this Agreement is held in whole or in part to be unenforceable for any reason, then the remainder of that provision and the balance of the Agreement will be severable and remain in effect.

Attorney’s Fees

If there is a dispute involving this Agreement is resolved in a third- party judicial proceeding, including arbitration, then the prevailing party will have a right to be reimbursed its attorney’s fees and costs for enforcing its rights under this Agreement.

Interest

In the event a dispute involving an unpaid amount under this Agreement is resolved in a third- party judicial proceeding, including arbitration, JMI is entitled to interest as set out in the Quotation starting on the date the unpaid amount became due.

SCHEDULE “B” POLICIES AND GUIDELINES

Insurance

JMI carries the basic insurance described in section (a) below at no extra charge, for the property being moved. Damages do occasionally occur. For additional insurance beyond the basic insurance provided below, you must contact your homeowner’s insurance provider and provide extra insurance yourself.

Basic $0.60 per pound, per article

This option provides for reimbursement of lost or damaged item(s) based on $0.60 times the weight of the item(s), regardless of the item’s actual value. ($0.60 per 100 lbs.= $60.00).

High Value Items

Items of extraordinary monetary, artistic, or sentimental value (antiques, family heirlooms, art objects, paintings etc.) should be identified to the estimator and the site supervisor prior to the start of the move. These may need to be insured separately and special handling may be required. Failure to disclose high value items may result in the denial of an insurance claim.

Scratches, Dents, Etc.

Despite precautions and best intentions, minor scratches, nicks, and dents are possible. JMI will not provide discounts for any of these minor blemishes. JMI will resolve issues of damage caused by gross negligence or You may file an insurance claim. If any items carry significant personal or sentimental value, You must notify us in writing or by email at office@jasonsmoving.com at least five business days before the Move Date so we consider how best to plan for the move.

Damage Claims

You should take photos from all angles of Your property that will be moved. You must notify JMI of any damage on the Move Date. If making an insurance claim for damage, the invoice must be paid in full prior to a claim being filed. You cannot withhold funds for perceived damage or perceived value of alleged damage to item(s).

Rental Truck(s), Self-Storage Containers, Pods, Etc

When JMI provides loading and/or unloading of Your rental truck, self-storage unit, container, or POD, JMI is only responsible for items while they are in its immediate care. You are responsible for property at all other times.

Preparing For Your Move

Parking

You must ensure valid and safe parking is available for moving truck(s). You will be charged parking fines received, plus an administration fee, if You did not obtain proper parking documentation.

If your driveway or laneway is not sanded/salted or otherwise safe and as a result, our truck or one of our rental trucks gets stuck or incapacitated You will be charged and liable for all costs associated to this including but not limited to towing fees, mechanical fees, service calls fees, etc.

Safety

JMI employees, agents, contractors, or representatives will refuse service if conditions are deemed unsafe. If conditions are not safe You will be charged a minimum of three (3) hours of service or actual time spent on your move up to that point including travel time, whichever is greater. Driveways and walkways must be sanded or salted to ensure safety.

You will be charged at the contracted hourly rate for JMI employees to salt and sand the area should they decide to do so, however, they may refuse service and no refund will be given. JMI reserves the right to cancel the move if the walkways cannot be made safe and You will lose the deposit and incur additional charges for fuel, mileage, labor, etc.

Elevators

You must reserve elevators at Your current address and Your destination address in advance. You must also ensure ahead of time that all of your items will fit in the elevator.

Measurements

You must ensure all furniture and appliances will fit through all hallways, corners, and angles throughout the Move From location, as well as through all doorways in the Move To location. If any new doors or door frames have been added or any changes to Your home since You moved in all of Your existing furniture have been made, or any furniture has been assembled inside the home, we highly recommend remeasuring all of Your furniture, doorways, entrance ways, hallways, corners, angles, etc. to ensure Your furniture and property can be moved.

Outdoor Property

If You have property outside (furniture, hot tubs, structures etc.,) placed before modifications, renovations, or landscaping were performed, then You must notify JMI so that JMI can determine if the property is still movable from its current location.

Doorways

If entrance doors, doors to appliances, or any other disassembly is required to fit property through doorways, entrances, etc., You must disassemble said items, doorways, entrances, etc.

Your Availability

JMI will not move property without You or a representative present for all phases of the move and will charge waiting time if You or representative is unavailable. Please provide our office with all contact cell phone numbers, as landlines are often disconnected prior to the move.

Walk Through Policy

Although several “walk-throughs” will be performed on the day of the move to ensure the moving crew knows exactly what is to be moved and nothing has been left behind or left in the moving truck at delivery. You must ensure each phase of the move has been completed to Your satisfaction. Return trips for “forgotten” items will be charged to You. Please ask the site supervisor for a checklist and accompany them on the final “walk through”.

PBO (Packed by Owner) Policy

If You elect to pack Your own property, please refer to the “Moving Tips” document for instructions. All items that can fit into a standard carton (1.5 to 6 cubic ft.) must be packed.

All boxes shall be NEW or in “like-new” condition, for security of contents. All boxes must be sealed with a lid, taped securely with packing tape, and labelled. All boxes must weigh less than 23 kg. JMI is not liable to You for the contents of a PBO carton or to You for any damages arising out of or related to items that are packed by You.

Exterior Risks

Driving over a lawn, sidewalk, or other areas not suitable for a truck may cause tire ruts, cracking of concrete, damage to plants/trees, damage to sprinklers and/or light fixtures.

Please ensure the designated area for our moving trucks is accessible and will not cause damage. JMI is not liable to You for any of the damages and/or towing charges that may occur if You request for JMI to perform any of the above actions.

Non-Allowable Items

JMI cannot transport items that could leak, combust, corrode, explode, spill (all liquids), spoil, or anything deemed illegal by law. Customers must pack and transport all of their own liquids, kitchen and cleaning supplies, etc. Please refer to the “Moving Tips” document for a comprehensive list. All gasoline, oils, and fluids must be drained from all lawn mowers, engines, power tools, and tanks. JMI is not liable to You for any circumstances that may arise due to undrained tanks carrying hazardous materials. Propane tanks (empty or full) cannot be transported by JMI. JMI will not handle or transport any firearms or ammunition.

Appliances

JMI will transport washers, dryers, refrigerators, freezers, and other appliances.

JMI will not assist with disconnecting and reconnecting water lines from Your appliances. JMI employees are not plumbers nor experts regarding the water systems of the Move To location or the Move From location.

JMI is not responsible to You for any damages arising out of appliances that are improperly reconnected. You must look for signs of water collecting at the base of Your washing machine, refrigerator, and freezer in the weeks after Your move. JMI employees are not permitted to offer assistance with this. JMI highly recommends contacting a professional plumber to handle these connections and reconnections. JMI is not liable to You for any leaks or damage that may result in the disconnection or reconnection of water lines.

JMI will not touch or disconnect any gas lines.

Refrigerators and Freezers Must be empty, defrosted, and dry 24 hours prior to the move.

JMI will not be liable to You for any damage that occurs to the appliance if moved with condensation inside or for any water damage that occurs due to the appliance leaking water. JMI is not liable to You for food spoilage or safety or damage caused by food or liquid spilled on other items.

Electronics

You must disconnect and pack wires, cables, and cords from electronics such as computers, TVs, stereo systems, etc. JMI will not disconnect, reconnect, or set up any computer, stereo, or audio/video systems. The functionality of internal components of electronics will not be covered by JM.

Flat Screen Televisions

LCD and Plasma televisions must be properly prepared for transport. You must remove televisions from stands and all detachable cables and wires and pack in its original container or properly wrap and secure in a crate, for maximum protection. JMI recommends that a qualified third party prepare televisions for transport and reassembly at destination in Your presence. JMI is not liable to You for damage to improperly wrapped or crated televisions, damage after storage, or failed pixels on television units.

Contents of Furniture Drawers

You must remove all contents, except duvets and pillows, from furniture drawers and pack them in boxes, bags, or totes. See the “Moving Tips” documents for guidelines. JMI will not be held liable to You for the contents of drawers or cabinets or damage to furniture if contents are left in drawers or cabinets.

Contents of File Cabinet Drawers

You must remove all contents from file cabinets which are taller than two drawers. All four-drawer, lateral, and other large file cabinets must be completely emptied, and contents packed. JMI is not liable to You for the contents of any drawers or damage to the file cabinets that may result due to contents being left in drawers by You.

Pots, Planters, and Barrels

When possible, soil should be removed from pots, planters, and barrels by You prior to transportation. Please keep in mind that soil can add extreme weight and may subject the container to stress leading to cracking, breakage, and deterioration of the container. JMI is not liable to You for damage to pots, planters, or barrels when transported full of soil. JMI reserves the right to refuse heavy/fragile planters.

Stone Related Items

Stone, marble, granite, concrete, porcelain, terra cotta, clay, etc. may have internal or external chipping or cracking which may not be visible and even with proper padding and care is subject to further damage. JMI is not liable to You for damage to any of these materials.

Wall Attachments and Fixtures

JMI will not remove any items from any wall including TV mounts, light fixtures, chandeliers, shelving, cabinets, mirrors, paintings, or any other item(s) attached to a wall. JMI will not attach or hang anything on any wall at the Move To location.

Disassembly

Gym equipment, jungle gyms, outdoor swings, trampolines, and gazebos must be disassembled by You before the movers arrive. You must reassemble and verify the structural integrity of all outside structures after moving services have been completed.

You should disassemble all furniture, if possible, including bed frames, dressers with mirrors, furniture units with shelves, removable glass, removable items, etc., lamps and lamp shades, TVs attached to TV mounts, wall mounting units, and any other items that can be disassembled. JMI is not liable to You for the misplacement of assembly parts or hardware. Please transport screws, nuts, etc., and hardware in Your personal possession.

Disassembling items significantly reduces the possibility of damage to Your property while carrying it through the house, loading the moving truck or trailer, and during the transport phase. It also increases the efficiency of Your move so that You are invoiced for fewer hours.

Large pictures, glass furniture tops, and mirrors must be packed by You in picture/mirror cartons, available for purchase from JMI Large and valuable pictures and paintings must be padded, wrapped, and secured in crates.

JMI can provide disassembling and assembly of furniture if requested in writing or via email at office@jasonsmoving.com at least 5 business days prior to Your moving date. Disassembly and assembly of furniture or property will be provided at the hourly rate.

Particle Board Furniture. Particle board-type, self-assembly furniture (garage and utility cabinets, Ikea-type furniture, desks, etc.) is designed to be assembled once. This type of furniture is not structurally sound and is not meant to be taken apart or moved once assembled. JMI will do everything in our power to make sure these items are transported safely and securely, however, they will not be reassembled at destination nor covered by the valuation option selected. JMI is not liable to You for any damage that may occur to any particle board-type furniture.

Cribs and Bunk Beds

JMI will not disassemble or reassemble cribs or bunk beds. You must disassemble, reassemble, and verify the structural integrity of all cribs and bunk beds after moving services have been completed.

Aquariums, Terrariums & Animal Habitats

JMI will only move empty aquariums, terrariums, or animal habitats. All water must be completely drained and empty of all contents. Large or delicate habitats may require crate packing prior to the move. Please communicate Your questions with our office prior to Your move. JMI will not transport live animals of any type.

Personal Items and Plants

Before movers arrive, please identify, separate, and place all personal and very valuable items (wallets, purses, keys, cell phones, chargers, power cords for furniture or electronics, medications, cable or satellite boxes, TV controllers, jewelry, gold or silver items, passports, pink slips, sentimental and important items) in Your vehicle.

If these items are boxed or sitting out, they may be accidentally loaded onto the moving truck and will be difficult to locate later. Please transport all plants in Your personal vehicle. There are helpful instructions in the “Moving Tips” document. JMI is not liable to You for damage to or loss of living plants, personal items, jewelry, or medicines.

Items of Excessive Weight

JMI will not carry or transport items of excessive weight up or down any flights of stairs or uneven terrain if deemed unsafe by the movers or property damage could occur.

Pianos

JMI can expertly disassemble, protect, transport, and set-up all types of apartment and upright pianos. JMI does not and will not move Baby Grand and Grand Pianos. JMI will not carry or transport pianos up or down any flights of stairs. You may wish to schedule a professional tuning and inspection of the working elements of the piano after the move. JMI is not liable to You for the internal components of any musical instrument, barring any outward damage or negligence.

Pool Tables

JMI will neither disassemble nor reassemble pool tables.

Grandfather Clocks

You must prepare grandfather clocks for transport. Instructions are included in the “Moving Tips” document. JMI is not liable to You for the internal components of any grandfather clock.
